Terms and Conditions

These Terms and Conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.

1. DEFINITIONS

In these conditions, unless the context requires otherwise:

1.1 "Buyer" means the person who buys or agrees to buy goods from the seller;

1.2 "Bespoke Products" means any product or resource specifically monogrammed or custom made;

1.3 "Condition" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller;

1.4 "Delivery Date" means the date specified by the Seller when the goods are to be delivered;

1.5 "Goods" means the article which the Buyer agrees to buy from the Seller;

1.6 "Price" means the price for the Goods excluding carriage, packing, insurance and VAT;

1.7 "Perishable Goods" means any goods which could be lessened in value due to decay, spoilage or destruction.

1.8 "Special Orders" means any goods which require over printing embroidery or non routine production.

1.9 "Seller" means ExpoChef of Unit 4, Defender Court, Sunderland Enterprise Park West, Sunderland SR5 3PE and ;

1.10 "Website" means www.expochef.co.uk

2. CONDITIONS APPLICABLE

2.1 These Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer to the exclusion of all others terms and conditions including any terms and conditions which the Buyer may purport to apply under any purchase order, confirmation of order or similar document.

2.2 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Conditions.

2.3 Unless the Buyer cancels their order in accordance with Clause 10 or the Seller cancels in accordance with clause 2.5 below, acceptance of these Conditions and completion of the contract between Seller and the Buyer will take place when the Goods are dispatched.

2.4 Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

2.5 The Seller reserve the right not to accept the Buyers order. Such non-acceptance may result, for example, from the fact that a product ordered is out of stock or that the Seller is unable to obtain authorisation for your payment.

2.6 When you use ExpoChef services please read the section headed Additional Information.

3. PRICE, PAYMENT AND DESCRIPTION

3.1 Payment of the Purchase Price and VAT is payable at the time of order, once the card details have been authorised and stock availability confirmed.  Payment must be made with a valid credit or debit card acceptable to the Seller.

3.2 The Price shall be the Seller’s quoted price which shall be binding upon the Seller provided that the Buyer shall accept the Sellers quotation online via product pages.  The Price is exclusive of VAT

3.3 All prices are shown in £s sterling and include VAT (where applicable) at the applicable current rates but exclude delivery charges, unless expressly stated otherwise

3.4 Although we will take all reasonable care to ensure that all descriptions, details and prices of products appearing on the Website are correct at the time when the information was inputted onto the system, the information appearing on this Website at any time may not reflect the exact position at the moment you place an order

3.5 Please be aware that the colours and appearance of our products may vary slightly from the way they appear on the screen and we cannot guarantee that your monitor screen will accurately reflect the colour of the product on delivery. All measurements and sizes are approximate, although we make every effort to ensure that they are as accurate as possible.

4. THE GOODS

4.1 The quantity and description of the Goods shall be set out in the Seller’s product pages.

5. WARRANTIES AND LIABILITY

The Seller warrants that the Goods supplied will at the time of delivery correspond to the description given by the Seller all other warranties, conditions or terms relating to fitness for purpose, quality or condition of the Goods, whether express or implied by statute or common law or otherwise are excluded to the fullest extent permitted by law.

6. DELIVERY OF THE GOODS

6.1 Delivery of the Goods shall be made to the Buyer’s address within 28 days of order and full payment.  The Goods may be delivered in advance of the Delivery Date upon the giving of reasonable notice to the Buyer.  The Buyer shall make all arrangements to take delivery of the Goods whenever they are tendered for delivery.

6.2 The Seller shall not be bound to deliver the Goods until the Buyer has paid for them. Payment shall be due before the Delivery Date and time for payment shall be of the essence. 

6.3 Delivery charges may vary when you place an order. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors. The Seller shall be under no liability for any delay or failure to deliver the products within estimated timescales.

6.4 The Buyer must inform the Seller at the time of order of any special delivery requirements.

7. ACCEPTANCE OF THE GOODS

7.1 The Buyer shall be deemed to have accepted the Goods after the delivery to the Buyer.

7.2 After acceptance the Buyer shall not be entitled to reject the Goods which are not in accordance with the contract

7.3 The Buyer will notify to the Seller any loss or damage to the Goods within 7 days of receipt of the Goods shall be held for inspection to enable a claim to be made on the carrier.  The Buyer shall immediately notify the Seller if the Goods are not received within 7 days if the delivery date notified at the time of order dispatch. 

8. TITLE AND RISK

8.1 Title shall pass on delivery of the Goods.

8.2 Risk shall pass on delivery of the Goods.

9. REMEDIES OF BUYER

9.1 Where the Buyer rejects any Goods then the Buyer shall have no further rights whatever in respect of the supply to the Buyer of such Goods or the failure by the Seller to supply the Goods which conform to the contract of sale.

9.2 Where the Buyer accepts or has been deemed to have accepted any Goods then the Seller shall have no liability whatever to the Buyer in respect of those Goods.

9.3 The Seller shall not be liable to the Buyer for late delivery or short delivery of the Goods.

10. CANCELLATION

If you wish to cancel your order, you are entitled to do so within seven (7) working days of the order being accepted and obtain a full refund of the purchase price of the delivered products.

11. RETURNS

The Seller will exchange or refund any unused Goods, excluding Special Orders, Bespoke Products and Perishable Goods, that are returned to the Seller within 28 days of Delivery (this includes your right to cancel your order under the Distance Selling Regulations).  The Buyer shall be liable to pay a handling charge of £20.00 for any returned Goods.  The Goods must be returned in their original packaging.

THIS RETURNS POLICY DOES NOT AFFECT YOUR LEGAL RIGHTS.

12. FORCE MAJURE

The Seller shall not be liable to the Buyer for any failure to deliver Goods you have ordered or any delay in doing so or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond its reasonable control.

13. USE OF WEBSITE

13.1 The Seller does not accept any liability whatsoever for any loss which may arise from your reliance upon information contained on the Website.  The Seller reserves the right to change any information at any time and without prior notice.

13.2 The Website site may contain links to other websites operated by third parties. The Seller does not control any information, products or services in the linked websites and cannot accept any liability whatsoever for the content of such websites. Furthermore, the link does not imply any endorsement or approval of linked websites or of the products or companies to which they relate. Access to linked websites is at the Buyers own risk.

13.3 To the extent permitted by law, the Seller accepts no liability for any loss, damage or injury arising as a consequence of any advice provided on this website.

14. PROPER LAW OF CONTRACT

14.1 The contract is subject to the law of England and Wales.

14.2 If any part of these terms of use are found to be unenforceable as a matter of law, all other parts of these terms of use shall not be affected and shall remain in force.
